What is paid annual leave?

Paid annual leave is a period of rest, paid by the employer, that an employee earns each year after completing at least one year of service with the same employer. Under the Labour Law, this right aims to protect the employee's rest and productivity; it cannot be waived in advance or removed by contract.

Annual leave entitlement by seniority

The number of leave days increases progressively with the employee's seniority:

  • Less than 1 year: no entitlement yet (one full year must pass).
  • 1 – 5 years (inclusive): 14 days per year.
  • More than 5 and less than 15 years: 20 days per year.
  • 15 years or more: 26 days per year.

Employees under 18 or over 50 receive at least 20 days per year. For underground work, entitlements are increased by four days.

How is annual leave calculated?

This tool evaluates the seniority you enter against the tiers above and returns your entitlement. Unused leave is paid in cash over the last gross wage when the employment contract ends.

Example

An employee with 7 years of seniority falls in the "more than 5, less than 15" band and is therefore entitled to 20 days per year.

Frequently asked questions

Can annual leave be split?

If the parties agree, one part must be no less than 10 days, and the rest may be used in segments.

Does unused leave expire?

No. Unused leave accumulates and is paid over the final wage when employment ends.

Are weekends and public holidays deducted from leave?

Weekly rest days and public holidays falling within the leave period are not counted as leave.

Does the probation period count?

Yes, total service including probation counts toward seniority.
