What is sentence-execution (parole) calculation?
It shows how much of a finalised prison sentence will actually be served in prison. A convict may be released on conditional release after serving the statutory ratio, and may leave for an open institution or supervised release a set time before that date.
Conditional release ratio (Law 5275, art. 107)
After the amendment by Law No. 7242, the general conditional-release ratio for fixed-term sentences is one half (1/2). It is higher for certain offences:
1/2 — general rule (most offences).
2/3 — intentional killing, sexual offences, drug manufacturing/trafficking, torture and certain privacy offences.
3/4 — organised-crime offences, some terror offences and recidivists (art. 108).
Supervised release (art. 105/A)
A convict may be moved to an open institution or released under supervision 1 year before the conditional-release date. This period has been changed by transitional provisions from time to time, so it is adjustable in this tool (default 1 year).
How is it calculated?
Conditional-release time = total sentence × ratio.
Actual time in prison = conditional-release time − supervised-release period.
Supervision after release = total sentence − conditional-release time.
1 year = 365 days, 1 month = 30 days; the result is approximate.
