What is a late payment surcharge?

The late payment surcharge is an additional financial obligation applied for the delay period when taxes, premiums and similar public receivables are not paid on time. Its purpose is both to deter late payment and to compensate for the erosion in value of the public receivable. It is applied under Law No. 6183 on the Procedure for the Collection of Public Receivables.

How is it calculated?

The surcharge is found by multiplying the unpaid principal by the monthly surcharge rate and the number of months of delay: principal × monthly rate × months. For fractions of a month, a daily rate (one-thirtieth of the monthly rate) applies. The monthly rate is set by presidential decree and is updated from time to time; in this tool the rate is a constant you can update from the admin panel.

Legal framework

The surcharge applies to public receivables followed by bodies such as the tax office and social security. Delays in private-law relationships instead trigger default interest; the two should not be confused. The surcharge continues to accrue until the receivable is paid in full.

Example

At a monthly rate of 4.5%, for 10,000 ₺ principal and 3 months of delay: 10,000 × 0.045 × 3 = 1,350 ₺.

Frequently asked questions

Are surcharge and default interest the same?

No. The surcharge applies to overdue payments, while default interest applies to additional/ex-officio assessments for the period from the normal due date to accrual.

How often does the rate change?

The monthly rate may be updated by presidential decree according to economic conditions; confirm the current rate.

How are fractional months handled?

A daily rate (monthly rate/30) applies to fractional days.

Is this amount definitive?

No; it is an estimate. Rely on the relevant authority's calculation for the exact figure.
